Simple, professional Spanish Wills and Inheritance services from PALS Solicitor in Puerto de Mazarrón and La Manga
A Spanish Will is essential whether you own various properties or have nothing more than a bank account in this country!
Anyone who has been through bereavement and inheritance procedures, whether in Spain, the UK or any other country, will know how difficult it can be to negotiate the minefield of inheritance tax and distribution, and that these problems are only made worse by the emotional turmoil which can affect us at such times.
Drawing up a will
That's precisely why arranging a will and inheritance for your estate is absolutely critical, and no matter what the value is of your assets in Spain it is essential that all eventualities are catered for.
The relatives of someone who dies intestate (without a will) are not automatically entitled to inherit until it has been proven to the satisfaction of the authorities that they are the only legitimate beneficiaries, and this can be a lengthy and extremely frustrating procedure (especially if they are not resident in Spain), so leaving a will is of the utmost importance so as to simplify matters when you are no longer around.
In some circumstances, the problems for relatives can arise even when you are still alive!
In the UK a will is valid as long as it is correctly worded, signed and witnessed, but in Spain it is slightly more complicated. The document must be drawn up in a specific way and signed before a notary in order for it to be valid, and while a “home-made” will is fully acceptable in the UK this is not the case in Spain.
Therefore, it is essential to use a practised and experienced solicitor or lawyer, and for expats throughout the Mazarrón and La Manga areas PALS Solicitors are pleased to offer their services. Their team will ensure that your wishes are reflected and in accordance with inheritance law, and usually all you need to is compile a list of your current assets (and liabilities) and what you wish to happen to them when you pass.
The inheritance process
For those who have lost a loved one in Spain, again the legal and administrative system is a far from easy one to negotiate (as is the case in the UK), and without professional experience behind you it can soon seem impossible.
But of course, whether a will exists or not, PALS can provide that assistance, reducing your role to that of providing simple information where necessary and signing on the dotted line. This includes the process of settling inheritance tax owed (which tends to be rather lower than in the UK) and properly distributing the assets left by the deceased, a process which even native Spaniards very often find to be beyond them: to such an extent that the number of cases where potential beneficiaries forfeit their inheritance is astonishingly high, at times reaching around 15 per cent!
Avoid such outcomes by allowing the trusted advisors at PALS to deal with your case and ensure that all assets are distributed fairly, as quickly as possible, in accordance with the wishes of the deceased if a will exists, and to the satisfaction of all – including the taxman!
